TERMS OF USE AND INFORMED CONSENT

 

Contractual Relationship

Please read these Terms of Use carefully, as they  constitute a legally binding agreement between you and Clindle/Ondoc, a service  provided by Clindle LLC. By accessing or using our services, you confirm  your acceptance of and agreement to be bound by these Terms. If you do  not agree, you must not use or access the services.

Arbitration Agreement

By using Clindle/Ondoc, you agree to resolve any disputes with  Clindle LLC through binding individual arbitration, rather than in  court. This includes but is not limited to disputes related to federal,  state statutory, small claims court, common law claims, or consumer  protection laws. This agreement precludes you from initiating or  participating in class actions, collective actions, or representative  proceedings against Clindle LLC.

However, both you and Clindle LLC retain the right to  bring individual actions in small claims court and to seek injunctive  relief in cases of intellectual property infringement.

Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT CLINDLE LLC  WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL,  EXEMPLARY DAMAGES, OR DAMAGES FOR LOSS OF PROFITS INCLUDING BUT NOT  LIMITED TO, DAMAGES FOR LOSS OF GOODWILL, USE, DATA OR OTHER INTANGIBLE  LOSSES (EVEN IF CLINDLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH  DAMAGES), WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY  OR OTHERWISE, INCLUDING IF RESULTING FROM: (I) THE USE OR THE INABILITY  TO USE THE SERVICE; (II) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND  SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES  PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO  THROUGH OR FROM THE SERVICE; (III) UNAUTHORIZED ACCESS TO OR ALTERATION  OF YOUR TRANSMISSIONS OR DATA; (IV) STATEMENTS OR CONDUCT OF ANY THIRD  PARTY ON THE SERVICE (INCLUDING WITHOUT LIMITATION ANY PROVIDER); OR (V)  ANY OTHER MATTER RELATING TO THE SERVICE. IN NO EVENT WILL CLINDLE’S  TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES OR CAUSES OF ACTION  EXCEED THE AMOUNT YOU HAVE PAID CLINDLE LLC IN THE LAST SIX (6) MONTHS,  OR, IF GREATER, ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OR  EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF  LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF  THE ABOVE LIMITATIONS SET FORTH ABOVE MAY NOT APPLY TO YOU OR BE  ENFORCEABLE WITH RESPECT TO YOU. IF YOU ARE DISSATISFIED WITH ANY  PORTION OF THE SERVICE OR WITH THESE TERMS OF SERVICE, YOUR SOLE AND  EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE SERVICE.

IF YOU ARE A USER FROM NEW JERSEY, THE FOREGOING SECTIONS  TITLED β€œINDEMNIFICATION AND RELEASE”, β€œDISCLAIMER OF WARRANTIES” AND  β€œLIMITATION OF LIABILITY” ARE INTENDED TO BE ONLY AS BROAD AS IS  PERMITTED UNDER THE LAWS OF THE STATE OF NEW JERSEY. IF ANY PORTION OF  THESE SECTIONS IS HELD TO BE INVALID UNDER THE LAWS OF THE STATE OF NEW  JERSEY, THE INVALIDITY OF SUCH PORTION SHALL NOT AFFECT THE VALIDITY OF  THE REMAINING PORTIONS OF THE APPLICABLE SECTIONS.

Services

Ondoc provides an online telehealth platform that  connects patients with healthcare providers via synchronous (live video  or phone calls) and asynchronous (text or chat-based) telecommunications  technologies. The professional services provided through Clindle/Ondoc are  referred to as "Services."

By using Clindle/Ondoc, you acknowledge and accept potential risks associated with telehealth, including but not limited to:

- Poor image or audio quality, which may impact medical decision-making.
- Delays due to electronic equipment failures or connectivity issues.
- Limited access to full medical history, which may lead to judgment errors.
- Potential privacy breaches if security protocols fail.

Prescriptions provided through Clindle/Ondoc are for your  personal use only. If you have questions about a prescription, consult  your provider or pharmacist. Ondoc is not liable for any adverse effects  or harm resulting from medications dispensed by pharmacies.

βœ” Free visits for up to 2 family members or friends

βœ” Weight loss treatment with semaglutide
βœ” Online mental health treatment (medication cost not included)
βœ” Low testosterone and ADHD treatment
βœ” Home delivery when applicable

Membership Fees:  These subscription fees are generally not covered under health  insurance, Health Savings Accounts (HSA), or Flexible Spending Accounts  (FSA). You acknowledge that you are solely responsible for these costs.

Cancellation and Refund Policy

Due to provider scheduling, we do not offer refunds once  an appointment has been completed. If you miss an appointment, you may  contact customer support within 2 hours to reschedule.

Membership fees are non-refundable after services have  been rendered under the plan. To cancel before any services are  provided, email [care@clindle.com] or call 5802158299

Important: Telehealth is NOT for emergencies. If you have an emergency, call 911 or go to the nearest emergency room.

Informed Consent

Telehealth services involve the use of digital  communications (e.g., video, audio, chat) to facilitate medical and  mental health care. Services may include:

- Prescription refills
- Medical and mental health consultations
- Therapy and counseling
- Lab and imaging referrals
- Diagnosis and treatment recommendations

Clindle/Ondoc encrypts all patient data to ensure HIPAA compliance and does not store payment information.

Service Limitations

- No physical examinations can be performed via telehealth.
- Telehealth is NOT for emergenciesβ€”call **911** for urgent situations.
- Providers may require in-person follow-ups or referrals when necessary.

Patient Acknowledgments

By using Clindle/Ondoc, you acknowledge that:
βœ” You provide accurate medical history and payment information.
βœ” Telehealth is not for emergency conditions.
βœ” Your telehealth visit records are confidential and part of your medical history.
βœ” When applicable, your health data may be used for billing, reimbursement, and care coordination.
βœ” Your information will not be shared with third parties for research or marketing without your consent.
βœ” You have the right to request a copy of your medical records.
βœ” Incomplete medical records may lead to adverse reactions or medical errors.
βœ” You are not guaranteed a prescription; providers issue prescriptions based on medical necessity.
βœ” No refunds are issued for missed appointments, prescription denials, or dissatisfaction with treatment plans.
βœ” By using Clindle/Ondoc, you consent to receiving text messages related to your care (message and data rates may apply).

Modifications to Terms

We reserve the right to modify these Terms of Use at any  time. Changes will be posted on our website, and continued use of our  services constitutes acceptance of any updates.
